Liability Waiver SquashPort, Inc. Terms and Conditions

I have voluntarily engaged SquashPort, Inc. and its instructors and employees to provide the below-named student with private, squash instruction sessions. Greens Farms Academy has agreed to permit student and SquashPort, Inc. with its instructors and employees to utilize certain facilities and areas of the Academy's campus for the Squash Instruction. I understand, however, that the Squash Instruction is not being offered by the Academy and is not part of the Academy's curriculum or extracurricular activities. I further understand that SquashPort, Inc. is not offering or providing Squash Instruction as an employee or volunteer of the Academy, and that the Academy will not be providing any oversight or supervision of the Squash Instruction. I understand and acknowledge that the student's participation in the Squash Instruction is completely voluntary, and that my decision to have the student participate in the Squash Instruction is my own. Any amounts of remuneration paid in exchange for the Squash Instruction will be agreed to between me and SquashPort, Inc. The Academy will not have any role in paying or collecting any such remuneration.
As a custodial parent or legal guardian of the student, I give the student full permission to participate in the Squash Instruction by SquashPort, Inc. My permission for the student to participate in the Squash Instruction is based upon my belief that the student does not have a physical or mental health condition that could affect the student's ability to safely participate in the Squash Instruction. My permission is also based upon my belief that the student has the maturity and self-confidence to work directly with SquashPort, Inc's instructors and employees, without supervision or oversight from me or from the Academy, and that the student will be able to respond appropriately to any challenges which the student may encounter with SquashPort, Inc's instructors during the Squash Instruction. In consideration of the student being permitted to utilize certain facilities and areas of the Academy's campus for the Squash Instruction, I agree, on my own behalf and that of the student, and our heirs, executors, administrators, personal representatives, successors, and/or assigns ("Releasors"), to forever release, hold harmless, and covenant to hold harmless and not to sue the Academy, its employees, officers, directors, volunteers, members, trustees, or representatives (collectively, "Releasees"), from any claims, suits, liabilities, or actions, including but not limited to, claims of negligence (but not gross negligence) on the part of Releasees, which Releasors may have now or in the future, which arise directly or indirectly out of the student's participation in the Squash Instruction. I recognize that there are risks inherent in, and specific to, participation in Squash Instruction, which cannot be eliminated without destroying the unique character of the activity. I acknowledge that the Squash Instruction is a physical activity, and that the student’s participation in the Squash Instruction may expose the student to certain risks, including, without limitation: overexposure to natural elements; participant's mental, physical, or emotional conditions (known or unknown, disclosed or undisclosed); inappropriate conduct or negligence by self or others; misjudgment by self or others; and other risks associated with engaging in competitive sports. I understand and acknowledge that these risks could result in property loss or damage, serious bodily injury, contraction of infectious disease, emotional injury, paralysis, or death.
I hereby knowingly and freely assume, on behalf of student, the risk of any and all losses and damages, known or unknown, including, but not limited to, personal injury, property loss or damages, and the potential negligence (but not gross negligence) of the Academy, which the student may incur as a result of participating in the Squash Instruction. In consideration of the student being permitted to participate in squash instruction, I agree, on my own behalf and that of the student, and our heirs, executors, administrators, personal representatives, successors, and/or assigns ("Releasors"), to forever release, hold harmless, and covenant to hold harmless and not to sue the SquashPort, Inc., its employees, instructors, or representatives (collectively, "Releasees"), from any claims, suits, liabilities, or actions, including but not limited to, claims of negligence (but not gross negligence) on the part of Releasees, which Releasors may have now or in the future, which arise directly or indirectly out of the student's participation in the Squash Instruction.
By signing this form, I acknowledge that I have carefully read this form in its entirety, and I have satisfied myself that I understand what it means, and that I have had the opportunity to ask questions and obtain whatever information I require to fully inform myself about the Squash Instruction, including the risks associated with the Squash Instruction.

I agree to allow my child to participate in various squash programs organized by 203 Squash Association, Inc. d/b/a Fairfield Squash (hereinafter “The Association") for the 2025-2026 school year and the summer of 2026. I further agree and acknowledge that The Association is under no obligation to allow him/her to participate in these programs. I agree that the Association is in no way responsible for the safekeeping of my child's personal belongings while s/he participates in squash programs organized by The Association. I understand that these programs may be physically strenuous, and I voluntarily give permission for my child to participate in them with full knowledge that there is risk of personal injury, property loss or death. In consideration of my child being permitted to participate in squash programs organized by The Association, I hereby completely release and forever discharge 203 Squash Association, Inc. d/b/a Fairfield Squash, their past, present and future agents, trustees, directors, officers, employees, fiduciaries, representatives, successors and assigns, from any and all past, present, or future claims, causes of action, or damages resulting from any injuries sustained by or related to my child's participation in their programs.
The Releasor acknowledges that s/he has carefully read the foregoing General Release of Liability and understands the contents thereof and signs this Release as his/her own free act.
